CLEARFIELD - Clearfield County District Attorney, William A. Shaw, Jr. announced today that a Clearfield County man has been sentenced to state prison for failure to comply with registration of sex offender requirements of Megan’s Law, a second degree felony.

Shaw identified the defendant as 53 year old David James Piper of Cherry Tree. Currently Piper is housed in the Clearfield County jail pending transfer to the State Prison System.

A criminal complaint filed on March 2, 2009 by Trooper Mark Rorabaugh of the Pennsylvania State Police, Punxsutawney Barracks, charged Piper with failing to comply with registration of sexual offenders as required by Megan’s Law.

An affidavit of probable cause filed with the criminal complaint alleges that the Pennsylvania State Police, Megan’s Law Section, sent an investigation request to the State Police Barracks at Punxsutawney stating that Piper failed to complete his annual verification.  

During the investigation, the State Police went to the previously registered address for Piper and discovered that no one was home at the residence. When investigating further at the Cherry Tree Post Office, it was discovered that Piper had changed his address.

The State Police went to the discovered address and located Piper, who stated that he changed his address at the post office over three weeks prior to that date.  Piper further relayed that he did not notify the State Police of his change in address because he did not have any gas money to go to the barracks to inform them of the change.  When asked about his failure to complete his annual verification, Piper relayed that he never received notice to report to the State Police Barracks.  

On May 21, 2009, Piper tendered a plea of guilty to the charges.  On July 27, 2009, Piper appeared before Judge Paul Cherry for sentencing.  Cherry sentenced Piper to a maximum period of four years in the State Prison System.  Upon release from incarceration, Piper is ordered to comply with all provisions of Megan’s Law.

Shaw stated that he was very pleased with the timely investigation by Tpr. Rorabaugh and the State Police.  Shaw reported that this case is "an example of Megan’s Law at work".  The Defendant failed to comply with the reporting requirements and the State Police located him and charged him within a very short time.
